Identifying Child Abuse and Neglect: When May the State Intevene?

The Social Services Law and the Family Court Act provide a series of definitions that determine when the state may intervene in behalf of a child, against the wishes of a parent. The legal definitions of abuse and neglect link two elements:

  • the parent's or other caregiver's conduct; and
  • its effect, potential or actual, on the child.
